Magistrate Court
Introduction
The Hays County Magistrate's Office is staffed by four Associate Judges who serve under the direction of the District and County Court at Law Judges in Hays County. The Magistrate Court holds these hearings seven days a week, 365 days a year, and ensures that each Arrestee is informed of their rights, the charges against them, and the amount of bail set. Associate Judges, acting as Magistrates, do not determine guilt or innocence and cannot provide legal advice.
The functions collectively referred to as "magistration" include those intended to protect crime victims, reduce crime rates, and uphold criminal defendants' due process rights. Legal processes include determining whether there is sufficient justification to hold a defendant in state custody, issuing legal warnings to individuals facing criminal charges, establishing bail, establishing bond conditions, obtaining search and arrest warrants, emergency protection orders, obtaining peace bonds, and conducting examinations.
